Please read these CampaignAutoPilot terms of service (“Agreement”) carefully before using our services. By clicking “agree,” “start my free trial,” “submit,” or any similar button on our website, or by using the services in any way, you (“Customer”) confirm that you have read, understood, and agreed to these terms.
You also confirm that you have the legal authority to enter into this Agreement. If you are accepting this Agreement on behalf of a company or organization, the terms “Customer” and “you” refer to that organization.
If there is a separate signed written agreement between the Customer and CampaignAutoPilot regarding the services, that agreement will take priority over these terms, excluding any printed terms on purchase orders or confirmations.
Order Forms; Access to the Service
Each order form submitted by the Customer becomes part of this Agreement. As long as the Customer follows these terms and any limits listed in the order form, CampaignAutoPilot grants the Customer a limited, non-exclusive right to access and use the software and services provided by CampaignAutoPilot (“Service”) during the active subscription period, only for the Customer’s internal business use.
Support; Service Availability
CampaignAutoPilot makes reasonable efforts to keep the Services available 24 hours a day, 7 days a week. Access may be temporarily suspended for scheduled maintenance, emergency issues, or if the Customer violates this Agreement, including failure to pay required fees.
Support is provided during normal business hours, Monday through Friday, based on the service plan purchased. The Customer understands that the Services may rely on third-party tools, APIs, or platforms, and CampaignAutoPilot is not responsible for issues caused by those third parties. The Customer is responsible for following any third-party terms.
Service Updates
CampaignAutoPilot may update, change, or improve the Services from time to time. These updates may include new features, security improvements, or system changes. Updates will not significantly reduce core functionality.
Any upgrades or fixes become part of the Services, but CampaignAutoPilot is not required to provide updates.
Ownership; Feedback
CampaignAutoPilot owns all rights, title, and interest in the Services, including all software, designs, and related intellectual property. No rights are granted to the Customer except those clearly stated in this Agreement.
If the Customer provides feedback, suggestions, or ideas, CampaignAutoPilot may use them freely without obligation or compensation. CampaignAutoPilot may also develop or offer products that are similar to or compete with Customer products.
Fees & Payment
Some CampaignAutoPilot features require payment (“Paid Services”). Pricing details are available on https://campaignautopilot.com.
By using Paid Services, the Customer agrees to pay all applicable fees. Payments are processed through third-party payment providers, and CampaignAutoPilot is not responsible for errors caused by those providers.
Subscriptions automatically renew unless canceled before the renewal date. No partial refunds are provided for unused time. Free trials must be canceled before the trial period ends to avoid charges.
If charged by mistake, the Customer may contact contact@campaignautopilot.com.
Restrictions
The Customer may not copy, modify, reverse engineer, resell, share access to, or misuse the Services. The Customer may not use the Services to build competing products, interfere with system performance, violate any laws, or infringe third-party rights.
CampaignAutoPilot may remove or restrict content if it reasonably believes it violates copyright or legal requirements.
Confidentiality; Customer Data; Publicity
Both parties agree to keep confidential information private and protected, except where disclosure is legally required or the information is publicly available.
Customer data remains the property of the Customer. CampaignAutoPilot uses reasonable security measures to protect data but is not responsible for unauthorized access unless caused by gross negligence.
CampaignAutoPilot may use anonymized and aggregated data to improve and promote its Services and may display the Customer’s logo as part of its client list.
Term; Termination
This Agreement begins when the first order form becomes active and continues until all subscriptions expire or are terminated.
Either party may terminate the Agreement for a material breach if it is not fixed within 30 days. CampaignAutoPilot may suspend access for unpaid accounts or harmful usage.
Certain terms, including payment obligations and ownership rights, survive termination.
Indemnification
The Customer agrees to protect and hold CampaignAutoPilot harmless from any claims, damages, or costs resulting from misuse of the Services, violation of this Agreement, or infringement of third-party rights.
Disclaimer
The Services are provided “as is” and “as available.” CampaignAutoPilot makes no warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
CampaignAutoPilot is not responsible for indirect, incidental, or consequential damages, lost profits, or data loss. Total liability will not exceed the fees paid by the Customer in the 12 months before the claim.
Miscellaneous
This Agreement represents the complete understanding between the Customer and CampaignAutoPilot regarding the Services.
Notices may be sent via email or registered mail using the contact details listed on https://campaignautopilot.com.
Neither party may transfer this Agreement without consent, except during a business sale or merger. If any part of this Agreement is found unenforceable, the remaining sections will remain valid.
